Correspondence received after publication of the agenda was distributed at the meeting. This comprised of comments received from Local Residents which included reference to the British Geographical Survey website.

 

In accordance with the procedure for public participation, Councillor Julia Wilks (South Darley Parish Council), Mr Paul Watts (Local Resident), Mrs Alayne Green (Local Resident) spoke against the application.

 

Consultation responses were set out in section 5 of the report.

 

The Senior Development Management Officer gave a presentation showing details of the application and photographs of the site and surroundings.

 

During debate Councillor Sue Burfoot moved to refuse the application seconded by Councillor Stuart Lees as it doesn’t meet Policy HC7 criteria 7.2 e) The scale, form, design and massing of the replacement dwelling does not detract from the character or appearance of its setting or surroundings.

 

The Chair called for an adjournment whilst the Development Manager, Senior Development Management Officer, Legal Services Manager, Councillor Sue Burfoot and Councillor Stuart Lees discussed the legal policy reasons for refusal.

Correspondence received after publication of the agenda was distributed at the meeting. This comprised of an updated response from Derbyshire Wildlife Trust addressing the Biodiversity Net Gain assessment with the associated updated Local Plan and a statement from a member of the public.

 

In accordance with the procedure for public participation, Mr Justin Stevenson (Agent) spoke in support of the application.

During debate Councillor David Hughes proposed an additional condition should be added that Disabled parking should be provided near to the new Club House and Officers should consult with highways on the number of places to be allocated.

That planning permission be approved subject to the conditions set out in the report and an additional condition on disabled parking facilities as follows:

 

1)      Prior to occupation of the development hereby permitted details of provision of parking facilities for disabled persons shall be submitted to and approved in writing by the Local Planning Authority. The development shall be implemented in accordance with the approved details.

Reason: In order to provide access for disabled persons in accordance with Policy HC17 of the Adopted Derbyshire Dales Local Plan (2017).

Correspondence received after publication of the agenda was distributed at the meeting. This comprised of a change to Section 8, Condition 7 and amendment to the resolution:

 

Amended Condition 7:

Notwithstanding the submitted details, no means of enclosure shall be erected until the design, location, and materials to be used on all boundary walls/fences/screen walls etc. have been submitted to and approved in writing by the Local Planning Authority. The boundary treatments so approved shall then be completed prior to the occupation of any of the dwellings and shall thereafter be retained in perpetuity.

Reason:

To preserve the amenities of the area in accordance with Policies PD1 and PD2 of the Adopted Derbyshire Dales Local Plan (2017).

 

Whilst the application is to be affordable housing as specified in the application form as 3 social, affordable or intermediate rent dwellings, this requires securing through a Section 106. The resolution therefore requires the following amendment: -

RECOMMENDATION: To APPROVE subject to conditions outlined above and in Section 8 upon completion of a s106 legal agreement to secure 3 dwellings as affordable units with delegated authority to the Director of Place and Economy to approve any amendments to those conditions as deemed necessary
