Election of a Chairman

Proposal that a Member of the Sub-Committee be elected Chair.

It was moved by Councillor John Bointon, seconded by Councillor Laura Mellstrom and

 

RESOLVED (unanimously)

 

That Councillor Joanne Linthwaite be elected as Chair of the Sub-Committee.

 

The Chair decalred the motion CARRIED.

Licensing Act 2003 - Application for New Premises Licence - The Lightweight Adventure Festival - Tideswell Moor Buxton SK17 8JD pdf icon PDF 113 KB

This report informs the Committee of an application made under section 17 of the Licensing Act 2003, by The Lightweight Adventurers Ltd, for a Premises Licence, to allow films, the sale of alcohol, provide regulated entertainment and late-night refreshment at an annual event, called the Lightweight Adventure Festival, during July at Tideswell Moor, Tideswell, Nr Buxton.

It was reported that, in accordance with the Council’s Licensing Procedures, an application had been received from Lightweight Adventures Ltd for a Premises Licence made under section 17 of the Licensing Act 2003, to allow films, the sale of alcohol, provide regulated entertainment and late-night refreshment at an annual event during July at Tideswell Moor, Tideswell, Buxton.

 

The circumstances of the Applicant’s referral to the Sub-Committee were as a result of objections being made to the application by three Local Residents. As these objections could not be resolved to the satisfaction of all parties by the Licensing Manager, the matter was referred to the Sub-Committee.

 

The Chair invited the participants to introduce themselves, asked whether any party wished the Sub-Committee to consider the application in private and confirmed that the Sub-Committee was quorate.

 

The Licensing Manager gave an outline of the application.

 

The Sub-Committee and other parties were afforded an opportunity to request clarification of the Licensing Manager’s report.

 

The Sub-Committee then heard representations from the following:

 

·         Ms Wendy Mycock, Ms Suzanne Bettney (Witness) and Mr Anthony Burton (Witness)

 

·         Mr Michael David Critchlow and Professor Gary Critchlow (Witness)

 

·         Ms Susan Clark, Ms Suzanne Bettney (Witness), Mr A Bettney (Witness) and M Robinson (Witness)

 

·         Ms Susan Clark representing Mr Peter Atkin, Angela Goodwin (Witness), Ms Pauline Salt (Witness) and Mr Stephen Ferris (Witness)

 

The Sub-Committee had the opportunity to question any of those making representation. The Applicants were also afforded the opportunity to request clarification of any points.

 

The Hearing adjourned at 12:22pm for a comfort break and reconvened at 12:36pm.

 

Mr Marc Deri, Mr Jim Evan and Mr Jamie Thoms then presented their case for The Lightweight Adventure Festival.

 

The Sub-Committee had an opportunity to question the Applicants.

 

All parties were afforded an opportunity to request clarification of any points.

 

The Licensing Manager and the Applicants were offered the opportunity to summarise their case.

 

The Sub-Committee Members confirmed that they had sufficient information to make a decision and withdrew into private session to discuss their findings.

The Sub-Committee resumed in public session.

 

It was moved by Councillor Joanne Linthwaite, seconded by Councillor John Bointon and

 

RESOLVED (unanimously)

 

That having considered all the evidence put before it, the Sub-Committee determined that the Applicant will be granted the Premises Licence, subject to the conditions as detailed in Appendix 2 to the report, with the addition of the following conditions:

 

·         There will be no BBQs, fire pits or similar open fire sources on site.

 

·         There will be no recorded music before 11:00am

 

·         There will be no amplified music after 11:00pm

 

 

The Chairman declared the motion CARRIED.
